Arnab Hazra, Kolkata: All apartments in the state will be selected through online system. On Wednesday, Justice Rajasekhara Mantha directed this in the context of a case in an apartment. According to the West Bengal Apartment Ownership Act, there will be a selection of as many apartments as there are. Whether online or offline, this was the subject of controversy (Calcutta High Court on Apartment Selection).
A single bench on Wednesday ruled in Newtown’s Rose Dale apartment case that all apartments under apartment ownership would be selected online and that residents would vote by electronic ballot in this online election. As per the rules, the responsibility of managing the apartment rests with the Board of Managers. The Board of Managers is elected every three years. The number of flats in Newtown Rose Dale Residence is about 600. The Board of Managers was elected through online elections in 2019. They have been running the apartment for so long. A few days ago, the care authority or competent authority created for the Apartment Ownership Act dissolved the board of managers of Rose Dale Housing and appointed an administrator.
Rose Dale Apartments filed a lawsuit in the High Court challenging the competent authority’s decision. In that case, Justice Rajasekhara Mantha’s significant instruction on Wednesday. The competent authority’s decision has been overturned by the High Court. On behalf of the plaintiffs, lawyer Sreejib Chakraborty said that all the apartments registered in the state under the Apartment Ownership Act will be selected online. The High Court has directed to publish the list of voters with e-mail IDs before the polls. In the case of Rose Dale Apartments, the directive will affect all apartments.
South City, Urbana, Abhisitka – Elections in all the big apartments will now be voted on online via e-mail ballot. The election schedule has been fixed at Rose Dale. The election of board managers is scheduled for May 26, 2022 and the last date for submission of nominations is May 19, 2022. The list of all eligible voters with e-mail ID should be published on the notice board of the society by May 16, 2022. Notice of High Court order should also be sent to all members through e-mail. Ballot secrecy will not be protected if voting is done online. The competent authority’s argument was not upheld in court.
